Ticketing and Sale of Goods Terms and Conditions

These terms and conditions relate to tickets issued for events at the Schwarzman Centre and goods sold by the Schwarzman Centre and form part of the contractual agreement between ticket holders and the Schwarzman Centre. Please read them carefully.

The Schwarzman Centre aims to treat all ticket holders with care and respect, ensuring their safety, security and enjoyment at an event. We request your compliance with the following to assist us in doing so.

All references to “we”, “us” or “our” are in relation to the Schwarzman Centre, as the venue, it’s staff and event delivery partners.

1.    Tickets and Distribution

1.1 The ticket remains the property of the Schwarzman Centre and may be withdrawn, with admission to the event refused at any time.

1.2 Limits on the number of tickets available for purchase by an individual may be in place. These limits will be stated on the event page at schwarzmancentre.ox.ac.uk. Failure to comply with these limits may result in some or all of the individual’s tickets being cancelled without notice.

1.3 Tickets cannot be returned, nor money refunded, except in the case of cancelled or rescheduled events or material changes. A material change is a change in which, in our reasonable opinion, makes the event materially different to the event that ticket holders could reasonably expect. Any refunds will be equal to the face value of the tickets paid but exclude any fees or additional items including donations and insurance.

1.4 Refunds will only be made to the ticket booker and where possible to the original method of payment. We reserve the right to offer a refund to an alternative method of payment should it be necessary, including providing credit on account.

1.5 It is your responsibility to check your tickets carefully when you receive them to ensure the details are correct. Please contact us immediately if you think there is a mistake at tickets@schwarzmancentre.ox.ac.uk.

1.6 The Schwarzman Centre cannot be responsible for lost, destroyed or stolen tickets. In some cases, replacement tickets may be issued but this is at our sole discretion, and a reasonable administration charge may be applied. Please contact tickets@humanities.ox.ac.uk if your tickets are lost, destroyed or stolen.

1.7 Where applicable, e-tickets will be emailed to the email address supplied at the point of sale. An e-ticket can be shown on a mobile device or printed on A4 paper for entry. If you have not received your e-tickets from us 48 hours before the event, please contact us at tickets@schwarzmancentre.ox.ac.uk. It is your responsibility to inform the Schwarzman Centre of any change of email address.

1.8 Where applicable, tickets will be delivered to the postal address supplied at the point of sale, though this may not be until 1-2 weeks prior to the event. If you have not received your tickets 48 hours before the event, please contact us at tickets@schwarzmancentre.ox.ac.uk. It is your responsibility to inform the Schwarzman Centre of any change of address.

1.9 If the Schwarzman Centre considers it necessary, tickets may need to be collected from the venue before the start of the event. Unless otherwise advised, this will be from 1 hour prior to the start of the event. We recommend collecting tickets no later than 30 minutes prior to the start of the event.

1.10 Tickets are issued solely for personal use and must not be resold for profit nor commercial gain nor combined with other products. Failure to comply may make the ticket void, invalid and non-refundable.

1.11 Any Schwarzman Centre Member who attempts to resell tickets for profit or commercial gain or combines tickets may have their membership revoked.

1.12 The Schwarzman Centre can facilitate a ticket exchange for an alternative performance of the same event, subject to availability and provided you have given 48 hours notice ahead of the original event start time. A £2 per ticket fee will apply.

1.13 We advise customers to only purchase tickets from the Schwarzman Centre and our authorised ticket agencies, event promoters, artists’ official websites and their authorised agents to be sure that you are purchasing a genuine and valid ticket.

It is prohibited to resell tickets without express written permission of the promoter, and we strongly discourage customers from purchasing tickets via unauthorised sources or ticket reselling services such as eBay, Facebook, StubHub or Viagogo.

The purchase of tickets from non-authorised sources can result in customers being refused entry and being unable to obtain a refund. In the event of a postponed or cancelled event the Schwarzman Centre will only be able to contact those customers who booked through an authorised agent and to process a refund to the original ticket booker.

2. Admission

2.1 A valid ticket must be presented for admission to an event.

2.2 Admission to an event is subject to the regulations and license of the venue. The Schwarzman Centre and the event promoter reserve the right to refuse admission, taking into consideration health and safety, environmental and security concerns.

2.2 Latecomers may have to wait until a suitable break in the event to enter and late admission cannot be guaranteed.

2.3 Security searches may be in operation. Failure to comply with any reasonable request for a security search will result in refusal of entry.

2.4 Pass-outs or re-admission are provided at the sole discretion of the Schwarzman Centre. Those individuals who are re-admitted may have to wait until a suitable break in the event and re-admission cannot always be guaranteed.

2.5 Age guidelines may be issued which are specific to the event booked. Not all events are suitable for children. Under 14s must be accompanied by an adult (18+). In some circumstances, adults may not need, or be allowed, to accompany the child into the venue. This will be clearly stated when purchasing the ticket. Age guidelines will be published online and in printed material wherever possible. We also advise parental discretion and provide content advice where available. Some events may have bespoke restrictions based on specific content. Please check the event listing for guidance. Neither the Schwarzman Centre nor our venue nor event partners will be responsible for unaccompanied children.

2.6 You must comply with all relevant statutes, safety announcements and regulations whilst attending the event.

2.7 Ticket holders consent to filming, sound recording, and being photographed as members of the audience. If you would prefer not to be included in any image recording, please speak to a member of the Schwarzman Centre staff. They will provide information on how to make sure you are not included. Notices will be posted at the entrance of the venue where recording is planned, with similar information.

2.8 We appreciate ticket holders may wish to stand or dance during an event. The Venue Manager will make the final decision whether this is appropriate, specific to the event.

2.9 If you experience any issues during the event, you must inform a member of staff at the Schwarzman Centre immediately as issues cannot always be resolved after the event.

2.10 The Schwarzman Centre reserves the right to refuse or revoke admission where a ticket is void or if the ticket holder’s behaviour is considered unreasonable by the Schwarzman Centre, in their sole opinion. Examples of unreasonable behaviour may include (but not be limited to); abusive, threatening, inebriated, intoxicated or other anti-social behaviour, carrying offensive weapons or illegal substances, making unauthorised audio, video or photographic recordings, being or appearing to be underage where event age guidelines exist. Any unauthorised recordings may be destroyed.

2.11 Certain items or activities are prohibited from all events (as listed in 4.1 to 4.5). Where additional items or activities are prohibited, we will inform you prior to attending the event. Failure to comply may result in ejection or refusal of entry to the event.

2.12 In the case of ejection or refusal of entry no refunds will be offered. 

3. Alteration

3.1 The Schwarzman Centre reserves the right to make changes to the event where the Schwarzman Centre believes it is reasonably necessary to do so.

3.2 Changes to the event may include, but are not limited to, altering the billing, start time, venue, seating arrangements and any other changes reasonably necessary which do not affect the nature of the performance. The Schwarzman Centre will use reasonable endeavours to communicate such changes to ticket holders as soon as is reasonably possible.

3.3 It may be necessary to make a material change to the programme of the event, to allow the event to continue as planned. 

3.4 The Schwarzman Centre will use reasonable endeavours to inform ticket holders of the cancellation or rescheduling of a performance. However, it remains the responsibility of the ticket holder to monitor whether the performance is cancelled or rescheduled. If an event is rescheduled, it is the ticket holder’s responsibility to ascertain the date and time of the rescheduled event.

4. Prohibition

4.1 The use of cameras and audio/visual recording equipment is not permitted. The use of laser pens or mobile phones is not permitted. Unauthorised recordings may be confiscated and destroyed.

4.2 Smoking or vaping is not permitted inside the Schwarzman Centre.

4.3 No glasses, bottles, alcohol nor any illicit substance may be brought into the Schwarzman Centre. Alcohol purchased from the venue may only be consumed in public bars and other authorised areas.

4.4 Babes in arms are only allowed where express permission from the Schwarzman Centre has been sought prior to entry.

4.5 Dogs are not permitted in the venue except guide dogs and assistance dogs. If you require a guide dog or assistance dog to accompany you, please inform us in advance.

4.5 Hate Incidents, Hate Crimes and any other form of harassment will not be tolerated at the Schwarzman Centre.

4.6 Prohibited include, but are not limited to: Firearms, fireworks, paint, flags, flares, musical instruments and other noise makers. Further prohibited items may apply for specific events.

5. Goods and Distribution

5.1 Additional items may be offered for sale by us. These items may be subject to varying fees for delivery and schedules for delivery, which may include a requirement to collect specific items from the Schwarzman Centre. We will inform you of these fees and delivery options during the sale process.

5.2 Limits on the number of goods/items available for purchase by an individual may be in place. These limits will be stated on the sales page at schwarzmancentre.ox.ac.uk. Artworks may not be re-sold without the express permission of the artist or the Schwarzman Centre. Failure to comply with these limits may result in some or all of the individual’s goods/items being cancelled without notice.

5.3 In accordance with the copyright, designs and patents act 1988, copyright and any and all other Intellectual Property Rights in the artwork always remains property of the artist. The artwork is sold by the Schwarzman Centre for non-commercial use only. Reproductions of the artwork may not be made, and the artwork may not be re-sold without the express permission of the artist or the Schwarzman Centre.

5.4 Should you wish to cancel any additional items and request a refund; you must return the items to us in a saleable condition within 14 days of receiving the item. The following items cannot be returned: donations, drinks packages, VIP packages, early admission packages, after show parties, goody bags. This does not apply to faulty or incorrectly supplied goods or services where your statutory rights are unaffected.

6.1 All the terms and conditions set out here apply to Schwarzman Centre Members.

7. Concessions

7.1 Where concession or discounted tickets are offered with specific eligibility requirements, both proof of eligibility and proof of identity may be required. If the ticket holder is unable to prove their eligibility, they may be asked to pay any difference in price between the concession ticket price and a full price ticket.

7.2 Ony one discount can apply to a ticket. You will be offered the best priced option when booking your ticket.

8. Access

8.1 Access tickets are provided to address the individual’s access requirements including for disabled people.

8.2 The Schwarzman Centre partners with Nimbus Disability and the Access Card to ensure industry standard access provision is available to all our disabled visitors and streamline the process of communicating your access requirements.

8.2 If you have any specific Access requests, please contact us at schwarzmancentre@humanities.ox.ac.uk.

8.3 Access ticket holders acknowledge that the Schwarzman Centre reserves the right to cancel any discounted or free tickets booked where the ticket holder is ineligible for Access tickets.

9. Ticket Price and Fees

9.1 The price of the ticket shall be the price set at the time we accept your order. We may apply flexible pricing to certain events, which means the price of the ticket may vary, subject to demand.

9.2 We aim to ensure that ticket prices displayed are correct. Despite our best efforts, sometimes tickets may be incorrectly priced. If we discover an error in the price of a ticket you have booked, we will contact you to inform you. You will have the option to continue with your booking at the correct price or to cancel your booking.

9.3 The price of the ticket shall be inclusive of any applicable taxes but exclusive of any ticket fee, transaction fee and collection or delivery fee. Any fees payable will be clearly stated during the ticket booking process.

9.4 For certain events a per ticket fee of 10% of the ticket price may be applicable regardless of any distinguishing feature or the number of tickets purchased.

9.5 The Schwarzman Centre may waive any or all fees for selected events or groups but reserves the right to alter this waiver without prior notice.

9.6 The Schwarzman Centre reserves the right to alter any future fees charged.

9.7 Any fees (where applicable) are non-refundable.

10. Force Majeure

10.1 For the purposes of these terms and conditions, “Force Majeure” means any cause beyond our control including without limitation, an act of god, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of local governments. The Schwarzman Centre will not be responsible to you for failure to perform any obligation under these terms and conditions to the extent that the failure is caused by a Force Majeure event.

11. Liability

11.1 Subject to clause 10.1, neither the Schwarzman Centre nor any of our event partners shall be liable beyond the face value of the ticket as at the time of its purchase.

11.2 Subject to clause 10.1, the Schwarzman Centre will not be responsible for any loss, theft or damage of your personal belongings.

11.3 Subject to clause 10.1, the Schwarzman Centre will not be liable for any costs incurred through your personal arrangements including travel, accommodation or hospitality relating to the event which have been arranged by you at your own risk.

11.4 The Schwarzman Centre does not exclude or limit in any way its liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; and for breach of your legal rights.

12. Dispute Resolution

12.1 If any dispute arises out of these terms and conditions, the parties will attempt to settle it. To this end, the parties shall use their reasonable endeavours to consult or negotiate in good faith and attempt to reach a settlement satisfactory to both parties.

13. Governance

13.1 Your statutory rights are not affected.

13.2 The Schwarzman Centre complies with both the Data Protection Act 2018 and the EU General Data Protection Regulation (GDPR) 2018 through our Privacy Policy.

13.3 These terms and conditions shall be governed by English law and the parties agree to submit to the exclusive jurisdiction of the English Courts.

14. Feedback

14.1 The Schwarzman Centre welcomes all feedback from ticket holders whether positive or negative. Please do so in writing to Schwarzman Centre Operations, The Stephen A. Schwarzman
